The UAE trademark system is governed by the Federal Trademark Law No. 36 of 2021, administered by the UAE Trademark Office.
 
Trademark classification in the UAE follows the 12th edition of the International Nice Classification of Goods and Services. Although the law permits multi-class filing system, it's worth noting that the practice within the Trademark Office may not fully reflect this provision yet. Therefore, applicants still need to file separate applications for each class of goods or services they wish to cover with their trademarks.
 
Upon filing, trademark applications undergo examination for registrability and prior rights. Accepted applications are published in the Trademark Journa for a 30-day opposition period. If uncontested, final registration fees are due, once the registration fee is paid the registration certificate is issued.
 
Under UAE law, trademarks must be used within 5 years of registration to remain valid. While use is not compulsory, non-use for five consecutive years may lead to cancellation upon application by an interested party.
 
Registered trademarks can be assigned, pledged, or licensed, with recordal applications published in the Trademark Journal and local newspapers. Amendments to applicant details or goods/services lists require publication, while amendments to the registered mark are possible if not essential.
 
Normal registration processing typically takes 8 to 12 months from the filing date. However, appeals or oppositions can extend this period to 24 to 30 months.
 
Trademark registration is valid for 10 years from the filing date and can be renewed for similar periods. Renewals are possible within the final year of protection or within six months after expiry with an additional fee.
